FAS issued a warning to Pobeda due to spam

The Office of the Federal Antimonopoly Service (FAS) in Bashkiria issued a warning to Pobeda Airlines for violating the law on advertising. The reason for the check was a complaint from a local resident who received ten promotional mailings from the carrier in April 2024. 

In the letters, the airline offered cheap tickets, talked about the May sale and recommended popular routes. However, as the applicant pointed out, the mailings came without his consent, which is contrary to the law.  

You can send ads by e-mail only with the prior consent of the addressee. Pobeda stated that the customer gave it when buying a ticket on the company’s website: when placing an order, the passenger automatically agrees to the privacy policy, which provides for the possibility of receiving promotional newsletters. In addition, the client can opt out of such messages at any time.  

However, the FAS noted that consent to the processing of personal data on the Pobedy website is issued in such a way that the passenger, accepting it, automatically allows them to send themselves advertisements. Otherwise, he will not be able to buy a ticket. In other words, consent to receive letters is not voluntary.  

Since this is the first violation of its kind by a low-cost airline, the FAS limited itself to a warning. The carrier may appeal the decision in court.  

Earlier TourDom.ru I wrote about a similar situation with Utair. The airline also sent out advertisements by e-mail without the consent of passengers. The FAS initially issued a fine, but then replaced it with a warning.
