The Government has approved for submission to the State Duma a draft law developed by the Federal Register aimed at reducing the time for the provision of land plots in state or municipal ownership at auction
The draft law prepared by Rosreestr,* which proposes amendments to the Land Code and Article 3 of Federal Law No. 385-FZ, was developed in accordance with the roadmap for improving land use efficiency approved by the decree of the Government of the Russian Federation on August 23, 2023. The existing procedure for conducting an auction for the sale of land plots owned by the state or municipal, or an auction for the right to conclude a lease agreement for such plots has been in effect since 2015, and this fact alone indicates that the system requires adjustments.
“This is due to the results of law enforcement practice and digitalization of public administration processes. For example, the timing of individual procedures is excessive today. And in some cases, the deadlines, on the contrary, are not defined, which delays the process of providing land plots at auction,” the Rosreestr explains.
In a speech at a government meeting, the head of the department, Oleg Skufinsky, recalled that this bill is the third stage in simplifying the provision of land to citizens and businesses. Prior to that, draft laws developed by the Federal Register on electronic auctions for the provision of land plots and on reducing the period for the provision of land plots without bidding (federal laws No. 385-FZ of October 7, 2022 and No. 509-FZ of December 5, 2022) were adopted.
“The current draft law proposes to halve (up to 14 days) the period from the moment of posting the notice of the auction to the date of its holding. Also, the deadline for signing a draft purchase and sale agreement or a draft lease agreement for a land plot sent to the auction winner is halved (up to 14 days), previously these deadlines were 30 days. These measures are primarily aimed at representatives of the business community, investors who will be able to quickly involve land plots in economic activities. In addition, the amendments proposed by the bill will reduce the investment and construction cycle,” Oleg Skufinsky noted.
In addition, the draft law establishes a three-month period from the decision to hold an auction to the publication of a notice of its holding. Currently, such a period is not legally defined.

Finally, the draft law provides for changes in the provision of land for “domestic” needs — individual housing construction, personal subsidiary farming, gardening. “In particular, today there are cases when a citizen submits to the authorized body an application for the provision of a land plot on one type of right (for example, ownership), but is refused, since third parties receive applications for the desire to participate in the auction on another type of right (for example, for lease purposes). The draft law solves this problem and proposes to specify the type of right that is indicated in the notification of the provision of a land plot. That is, applications for only one type of right will be accepted at the auction — either to obtain ownership of the site or to lease it,” Rosreestr experts note.
