A tourist from Sarapul tried to sue Rossiya Airlines for 450 thousand rubles for a flight delay on the Izhevsk – Moscow route. In the lawsuit, he explained that the late departure led to the disruption of his vacation in Venezuela.
According to the court materials, the plaintiff had previously purchased a ticket to Margarita Island from a tour operator for 150 thousand rubles with departure from Moscow. The man had to get to the capital on his own, so he bought tickets for the Rossiya flight from Izhevsk in advance. However, on the day of departure, it turned out that the flight was postponed due to a malfunction of the aircraft. The total delay was 7 hours and 14 minutes.
“The plaintiff was forced to cancel this flight because he was already late for the Moscow – Venezuela flight, as a result, he was unable to use a tourist voucher,” the united press service of the Udmurtia courts said.
In court, the man said that he wanted to receive compensation from the airline for the tour in the amount of 150 thousand rubles, as well as for moral suffering – another 300 thousand rubles.
During the meeting, the representative of “Russia” explained the reason for the delay of the flight from Izhevsk to Moscow. The schedule malfunction occurred due to identified problems with the aircraft’s fuel system, which had to be fixed. Therefore, the flight was postponed in accordance with security requirements, which is a circumstance that relieves the carrier of responsibility to the passenger.
As a result, the court sided with the airline. “Taking into account that the plaintiff independently docked flights and chose the route to Moscow, as a result of which a single route was not issued, the court concluded that the risk of liability for being late for the flight Moscow – Venezuela passed to the plaintiff. In addition, the court recognized the delay of the Izhevsk – Moscow flight as legitimate, since it was of a technical nature and was related to the safety of passengers,” the press service explained.
