The daughter of the singer Pelageya was not released abroad because of her father’s ban. Seven-year-old Taisiya and her grandmother found out about this when they were already at the airport. The singer reported about the incident on her telegram channel.
Grandma gave her granddaughter a ticket to Turkey in honor of the end of the school year. The two of them were supposed to fly to the resort from Sheremetyevo on May 26. Taisiya checked in her luggage, passed security checks, and was taken off the plane half an hour before departure.
Why the singer did not know about the existence of a travel ban for her daughter – the story is silent. Subscribers of the Roof of the Tourist House channel suggest that Pelagia’s ex-husband may have known about the planned trip to Turkey and specifically banned his daughter from leaving at the last moment before departure.
A parent submits a similar statement of disagreement on the departure of a minor child from Russia to the migration department, explained lawyer Igor Kositsyn. At the same time, the parent who imposed the ban can travel abroad with this child. Only the citizen who submitted the application can withdraw it.
Usually, the migration service sends a notification of the ban to the second parent by mail, Igor Kositsyn explained. But they may not be informed if the address of the second parent was not indicated in the statement of disagreement on departure.
If a person has not received such a letter, but there is a suspicion that a ban exists, you can contact the Migration Department with a clarifying request.
The parent has the right to challenge the travel ban in court. But practice shows that the court can cancel the current restriction only in important circumstances, for example, if the child needed to leave the Russian Federation for treatment abroad.
At the same time, sometimes the court gives the right to the second parent to take his son or daughter abroad during a certain period, while the general ban on departure remains in force and on other dates the child still cannot be taken out.
