When building a private house, owners often plan to build a sauna, garage and other buildings nearby. Is it possible to do this on the lands of garden associations and is it allowed to use a preferential mortgage?
“Everything is simple with a mortgage: no baths, garages, sheds, household units can be built with its help,” says realtor-practitioner Vladimir Shmelev. — The mortgage is given only for the construction of an apartment building: the bank must first coordinate the project. If a person has taken out a loan for individual housing construction, then he can assign a postal address to the finished object and register it — temporary or permanent. Apartment buildings and multi-storey buildings above three floors with a total height of 20 meters on the land of the SNT are also prohibited. It doesn’t matter what money they are built with. You can also not use residential or utility rooms for commercial purposes. Therefore, they will not be allowed to build a mini-hotel in garden associations.”
But even if the owner of the plot in the SNT is going to build his house without violations of technical requirements, he may still face other prohibitions. An easement may be imposed on the site.
“It happens that in the SNT one site is built up without problems, and on the other the owner can hardly afford anything,” the expert adds. “For example, there are restrictions from the power grid, gas supply organization, military units or airfields. If the site is located close to a large body of water and is part of a water protection zone, then only recreational facilities will be allowed to be built. Therefore, my advice is: look not only at the category of land, but also at all restrictions. To do this, before buying a site, you need to contact a cadastral engineer, study the urban planning plan and consider all the features of the future construction site on the geoportal.”
