Until recently, buyers of apartments in new buildings had 5 years to notice housing defects and demand that the developer eliminate them. But since September 1, 2024, the warranty period for housing has been reduced by two years at once. Is this enough to identify all the flaws?
“Even if the apartment is purchased with finishing from the developer, three years is enough to detect and eliminate deficiencies,” says Albina Sakaeva, founder of the residential complex repair company. — If the housing is not finished, then, as a rule, two years are enough to eliminate the most difficult and expensive defects. As practice shows, buyers of new buildings should first of all pay attention to the tightness of windows, the quality of the heating system, collector units, plumbing.”
There are two ways to eliminate defects in new housing. The first is to oblige the developer to do this, and the second is to demand money from the developer and eliminate defects on their own. For each day of delay, the buyer will receive a penalty from the seller’s company.
In addition, from September 1, 2024, a new fine will be introduced in favor of the buyer — 5% of the amount determined by the court. It will be applied if the developer evades his obligations. The buyer will also be able to collect money for moral damage, the amount of compensation is determined by the court.
