The high summer construction season has started, so the Ministry of Property Relations of the Moscow region decided to remind once again what and on which sites can be built. In order for the house not to be recognized as an unauthorized construction and not to have any problems at all, it is necessary to comply with all the norms of land legislation.

First of all, you need to make sure that the type of permitted use of the site (VRI) is suitable for the construction of an apartment building. Unfortunately, it is precisely this moment that the owners of allotments often forget. According to the law, it is possible to put a full-fledged house on plots for individual housing construction (IHS), for running a personal subsidiary farm (LPH) and for gardening. For reference: on land for farming, you can also build a garage, a bathhouse, a greenhouse and so on, keep farm animals, grow vegetables, fruits, grains and forage crops, and on land for gardening it is allowed to grow vegetables and fruits for personal use and, in addition to a garden or residential building, put garages, sheds and similar structures.

It is forbidden to build residential buildings on land with the type of permitted use “For gardening”: here you can only install a farm building for storing inventory and crops. Residential construction is also prohibited on plots with the VRI “Gardening” — this category of land is suitable only for the cultivation of perennial fruit and berry crops.

Experts from the Moscow region Ministry of Property Relations emphasize that “Gardening” and “Gardening” are different types of permitted land use, and urge citizens to be extremely careful not to confuse them. The easiest way to find out or remind yourself about the VRI of the site is to go to the website of the public cadastral map (pkk.rosreestr.ru ), enter the cadastral number of the allotment of interest in the search bar and find the necessary information in the “Information” section of the object card.

As for the parameters of the house, then, as the department reminds, it should be no more than 20 meters high and a maximum of three floors. At the same time, the structure cannot consist of apartments or block sections, and in general, initially the owners should not even plan to subsequently divide the house into independent real estate objects.

After the house is finally built, it is necessary to register it. This can be done in a simplified manner — under the so-called dacha amnesty, which is valid until March 1, 2031. Its rules are very soft: in particular, they do not require notifications about the beginning and completion of construction, as well as permission to put the house into operation.
